September 2008 – New Bailiffs Laws Weaken Landlords Position

The Government is proposing changes to the Law of Distress which is now to be called Commercial Arrears Recovery (CRAR).

Where business tenants are in arrears with their rent, landlords will no longer have had the right to send the bailiffs in, without warning, to confiscate goods to the value of the money owed.

Later this year, still to be finalised laws will require bailiffs to give warning of their visit, effectively ensuring that anything of value is removed before they arrive.
